The Freshwater Wetlands Protection Act, signed into law
July 1, 1987 and Revised September 4, 2001, mandates
that alteration or disturbance of land classified as a
freshwater wetlands and the discharge of dredged or fill
materials into State Open waters, requires a permit issued
by the New Jersey Department of Environmental Protection (NJDEP). |

who perform wetland identification and delineation are trained
to meet the technical requirements for the Army Corps of Engineers
(ACOE) Wetland Delineator Certification Program
(WDCP).
As part of its mandate to implement the provisions of the
Freshwater Wetlands Protection Act, the NJDEP has
developed protocols for evaluating the resource value of
freshwater wetlands. These protocols include assessing
whether threatened or endangered (T&E) species exist
at the subject property. Additionally, most local
Environmental Impact Statement (EIS) ordinances require
an assessment of existing conditions, which includes wildlife
and the possible presence of T&E species. Brennan
Environmental, Inc. wetland scientists who perform T&E species assessments
have experience with various species and habitat surveys, as
well as field study projects for T&E species and other regional
flora and fauna.
